Summary
A criminal judgment binds a civil court with respect to factual findings that were necessary to establish the crime, its legal characterization, and its attribution to the perpetrator, in order to avoid conflicting rulings and because criminal courts are better equipped to verify criminal facts. A civil judge is bound only by those facts that were essential to the criminal decision; factual determinations that were not necessary to the criminal judgment do not constrain the civil judge. Matters such as assessing the defendant's liability under the custodian-of-things rule (Art. 291) and any reduction of liability under Art. 264 due to failure to place warning signs, if not addressed in the criminal ruling, fall to the civil judge. Accordingly, the appellate court should exercise its power under Art. 185 of civil procedure to order a specialized traffic expertise to determine the defendant's contribution to the accident and to adjudicate the appropriate compensation.
