Nature of the Court and Legal Basis

The Constitutional Court is an independent judicial body with legal personality and financial and administrative autonomy, established following the 2011 constitutional amendments and regulated by a dedicated 2012 statute. Based in the capital, it performs constitutional review of laws and regulations under the Constitution and its implementing law; its decisions are published officially and carry binding legal effect.

Composition, Term and Eligibility Requirements

The Court is composed of at least nine members, including a president, appointed by royal decree following prescribed executive procedures, for a non‑renewable six‑year term. Eligibility requirements include Jordanian nationality only, minimum age of fifty, and membership drawn from specific professional categories (senior judges, law professors with professorial rank, or lawyers with extended practice). The president and members take an oath before the King prior to assuming duties. The law provides mechanisms to replace members and fill any shortfall in membership.

Impartiality Restrictions and Procedural Obligations

Membership requires full‑time dedication; members are prohibited from holding other public or private employment, engaging in commercial activity, serving on corporate or institutional boards, or affiliating with political parties. Members are also subject to asset‑disclosure rules and ethical instructions issued by the Court. These restrictions are intended to preserve impartiality and the integrity of constitutional adjudication.

Jurisdiction and Legal Effects of the Court’s Rulings

The Court reviews the constitutionality of existing laws and regulations; its judgments are final and binding on all authorities and are published in the Official Gazette within a statutory period to take effect. The Court also issues constitutional interpretations upon request by the Cabinet or either chamber of Parliament by majority vote, with interpretative decisions becoming effective after publication. Direct challenges to legislation before the Court are reserved to the Senate, the House of Representatives and the Cabinet; parties in ordinary proceedings may raise constitutional objections, which courts may refer to the Constitutional Court under the applicable legal mechanism if deemed substantial.

Administrative Organs and Their Operational Powers

A General Assembly governs administrative and institutional matters such as adopting the annual report, approving the Court’s contracts, issuing procedural instructions and codes of conduct, and proposing draft legislation necessary for the Court’s work. The Court President supervises execution of the Assembly’s decisions, manages the executive apparatus and represents the Court, with authority to delegate certain powers in writing. A Secretary‑General, appointed by the Cabinet, handles administrative and financial management, drafts the annual budget and prepares institutional reports. These bodies and functions operate under the statute and implementing regulations.
