Legal Purpose and Scope of Application
The Insurance Commission established the Fund to compensate victims when the at-fault vehicle lacks valid insurance or when the vehicle/driver cannot be identified (hit-and-run). The Fund operates under Instruction No. (6) of 2004 and its amendments, providing a limited indemnity where recovery from the insured party is not possible.
Covered Damage Categories and Indemnity Limits
The Fund covers death, permanent and partial disability, moral (non‑pecuniary) damages, temporary disablement and medical expenses within the compulsory motor insurance caps. Practical examples include JD 17,000 per death or total permanent disability, JD 17,000 multiplied by the percentage for partial disability, up to JD 7,500 for medical expenses, JD 100 weekly for temporary disablement (max 39 weeks), and JD 3,000 for certain moral damage awards.
Exclusions and Substantive Limits
The Fund does not pay where an exclusion in the applicable Compulsory Motor Insurance Regulation applies. The owner or driver who caused the accident is not entitled to indemnity under the Fund, and property damage is excluded. Users should consult the operative regulation for detailed exclusions.
Procedural Deadline for Filing Claims
Claimants must submit claims to the Fund within one year from the date of the accident. Observing this time bar is a key procedural requirement for entitlement, so claimants should document the accident date and follow the submission requirements set out in the Fund’s instructions.
Right of Recourse and Recovery of Payments
The Fund has a right of recourse against persons against whom the injured could have claimed, to the extent of amounts paid. The Fund may also seek repayment from a beneficiary who breached the Fund’s recoverability rights or who subsequently received compensation for the same damage from the driver, owner or any third party who paid on their behalf.
