Concept and Scope of Application
Electronic judicial notice means using modern communication tools to inform a litigant of measures taken against them in lieu of traditional delivery. The scope addresses personal, temporal and territorial dimensions: natural persons via their electronic means, legal persons via their authenticated channels, and notices to residents both inside and outside the Kingdom in accordance with applicable rules, subject to statutory time and procedural limits.
Advantages and Practical Effects
Relying on electronic notice accelerates service, reduces costs and effort, and enables digital archiving of notices. Practically it facilitates continuity of court operations in emergencies (e.g. pandemics) and reduces physical movement, but it requires securing the recipient’s channels and technical safeguards to protect confidentiality and integrity of transmitted data.
Accepted Channels and Procedural Controls
The legislator provided for specific channels such as email, SMS and the lawyer’s portal account, while allowing the Minister of Justice to adopt additional means. A defense order temporarily authorized using apps like WhatsApp and treated such notices as effective under its terms. Ownership verification of the recipient’s channel and courts’ internal security and sending procedures should be observed.
Formal Data Requirements and Consequences of Defects
The same statutory data requirements apply to electronic notices: date and time of service, name and address of the party requesting service, the court name, the recipient’s name and address, the subject of the notice, and identification of the person effecting service or proof of refusal. A defect or absence of any required item may render the notice void, so practitioners must check the governing provisions and procedures before relying on electronic service.
Case Law and Limits of Reliance
The Court of Cassation has applied electronic service rules in practice, conditioning procedural validity on actual notification and the absence of a justified excuse for non-appearance. Practically, electronic notice can be effective if performed in conformity with evidentiary and procedural safeguards, and courts assess each case based on proof of transmission and receipt.
